Xinhua has reported that the National People’s Congress is considering creating a unified IP appeal court in the Supreme Court. If this is so, it will be great advance for IP protection in China. It is unlikely the court would be able to hear all appeals, but having the possibility of a case been appealed directly to the SPC will improve the quality of lower level decision making and help reduce local protectionism.
