Vaping In Public In Washington: Restrictions And Exceptions

Vaping is becoming widely popular within the smokers’ community. While some smokers are switching to vapes for a safer experience, others are using them because they are discreet to use.

Perhaps, everyone has their own reasons to vape their herbs and vaping liquids.

However, like smoking, vaping also comes under the controlled substances act. And therefore, states and federal governments try to limit its consumption. Or, at least, try to limit where you can vape.

In 2005, the state of Washington passed Clean Indoor Act, which is now known as the Smoking in Public Places Law.

Under the Smoking in Public Places Law, smoking in any enclosed indoor public space was prohibited.

The law is applicable in all counties and cities within the state with no exceptions.

That being said, the laws for vaping in public places are not the same. Although for most parts the restrictions are the same, for vaping there are some exceptions.

Vaping In Public

As mentioned already, the legalities around vaping are more or less the same as those around smoking in public.

For example, vaping in public places of work and common meetings is banned. Likewise, open displays, tasting restrictions, and ads on coupons are also restricted.

In addition to these, there are requirements for child-proof or child-resistant packaging and labeling for all vaping products.

It is noteworthy that the law regulates every vaping product, whether it contains nicotine or not.

However, exceptions have been made concerning vaping products specifically. And notably, these exceptions may vary from county to county and city to city.

For example, in many counties tasting vape products within the facilities that sell vaping products is not illegal. Meaning, you can taste a vape in a dispensary if you wish. However, a washington dc vape shop will need to comply with state or county regulations. And would also need to obtain a license to offer in-store tasting experiences for their customers.

 

Sampling And Coupons Regulations

Apart from vaping in public places, sampling and coupons are also regulated for vaping products in the state of Washington.

For example, in general, sellers cannot offer any coupons to the buyers, unless they buy a product first. In other words, distributing free vaping coupons is restricted.

As far as the sampling is concerned, it has already been explained that tasting in public places is not allowed. The store owners, however, can offer a sampling of vaping products inside their enclosed facility, given that they have a proper license to confirm it.

It is noteworthy that the FDA has banned tasting and sampling nicotine-containing vaping products. However, for non-nicotine products, the sellers or samplers need consent from the consumer.

Apart from this, the sale and mailing of vaping products on the internet need to be backed by proof stating the buyer are above 18 years or older.

Vaping in public is acceptable as far as it is done with the consent of others in the proximity. However, vaping indoors should be avoided at all costs. The reason is, like second-hand smoke, second-hand vapes may also have effects on the passers-by.
