An advertising agency won its bid to prevent a rival firm from using what it says are confusingly similar trademarks while their dispute is litigated, after a federal judge ruled there is a likelihood of confusion.
The Mars Agency’s request for a preliminary injunction preventing Xmars Corp.’s use of the “Xmars” word and design trademarks was granted, according to an opinion Friday by Judge Otis D. Wright, II of the US District Court for the Central District of California.
