As editors of this anthology, we took this anniversary as an opportunity to invite court presidents, judges and academics from other jurisdictions to take an outside look at the Court and its work. The aim is to supplement German self-observation, including from the perspective of other disciplines, with international observation. Our goal was to reflect the perception of the Federal Constitutional Court and communication with it through a multitude and diversity of voices. This volume brings together 39 contributions from 40 national and two international jurisdictions.
Our general question about how the court is perceived from the outside can be broken down into numerous sub-questions: How does the Federal Constitutional Court interact with foreign supreme courts and scientific communities? Which court rulings, if they are noticed at all, are received positively, and which ones attract criticism? Has the perception of the Federal Constitutional Court changed over time? Have there been phases of particularly close cooperation and phases of indifference or alienation? Are lines of argument and legal concepts adopted and, if so, are they modified? Does the Federal Constitutional Court inspire in other ways? What seems disconcerting from an international perspective? What can the Federal Constitutional Court and German legal scholarship learn from the international perspective, what have they learned so far?
