But the lawsuit does more than assert a trademark violation. It also told the story of how the Camden-based firm, now called The Campbell’s Co., developed its “famous and beloved” can.
The suit said legal protections for the can’s “distinctive trade dress,” or visual characteristics, date back as far as 1905.
And it asserts Jane Foodie LLC of Yonkers copied Campbell’s soup can “to launch and promote its own competing line of canned soup and sauce products.”
It also said Jane Foodie rebuffed Campbell’s efforts to avoid a court fight, and instead “responded with threats.”
Among other allegations, the suit claimed an unnamed principal at Jane Foodie told Campbell’s, “Good luck in taking this to court as you will just increase the visibility of my brand.”
