This fourth edition of The Law of Privacy and the Media is the first in which the chapter structure from the previous edition has been retained. The law is now sufficiently settled that, as in the third edition, this iteration of the book considers sources and principles of privacy law, breach of confidence, misuse of private information, harassment by publication, data protection, privacy and defamation, copyright, intrusion, defences, remedies, practice and procedure, privacy codes, and privacy and the internet.
But even though the structure of the book remains the same, there are dozens of new cases and legislative measures considered in this edition. This new material responds to a range of different factors. The departure of the United Kingdom from the European Union in 2020 (‘Brexit’) has, of course, fundamentally altered the backdrop against which all legal developments are understood. In the privacy context, this has had a particular impact on UK data protection; those impacts are considered in Chapter 7 of this book. The influence of social media on all aspects of modern life has also continued to grow. Discussion of cases considering its use, and more often misuse, is woven throughout this edition, as well as being the focus of our final chapter, ‘Privacy, the Internet, and Social Media’. This new edition also examines decisions applying the Independent Press Standards Organisation code which came into effect just before the last edition was published. The application of that press self-regulation regime is considered in detail in Chapter 14.
