The Afghanistan Independent Bar Association (“AIBA”) was established in 2008 under Afghanistan’s Advocates Law. The AIBA’s raison deter is to oversee the licensing and regulation of lawyers, promote professional excellence and equal opportunity in the legal industry, train future lawyers, and to champion the rule of law and social justice. The AIBA has established itself as an independent institution furthering fundamental rights, due process, judicial independence, the rule of law, and democratic values. Within a decade, the AIBA established the status of lawyers in Afghan legal society, with over 5500 defense lawyers, among this number more than 25% are women. The AIBAIE played a key role in providing justice, supporting the rule of law, and protecting the rights of citizens. Sins the Taliban’s rise to power resulted more than 25% of the female members of AIBA are being held in their homes with an unclear future and are unable to engage in legal activities and other members live are in a very critical situation.
On August 15, 2024, the AIBA in Exile issued a statement marking the third anniversary of the Taliban’s takeover. The statement highlights the collapse of Afghanistan’s legal system and ongoing human rights violations, including the suppression of women’s rights and the absence of judicial independence. The AIBA in Exile criticized the international community’s lack of action, particularly the United Nations, and called for urgent measures to protect defense lawyers, support Afghan refugees, and hold the Taliban accountable. The statement urges the global community to prioritize the needs of the Afghan people and push for an inclusive government while ensuring continued humanitarian aid.
