This lecture considers how the content of foreign law is established, and the circumstances in which the law of the forum can be applied in default. It reviews and evaluates the various alternative approaches to establishing foreign law – expert evidence, obtaining reports or decisions from the foreign court, the use of a special referee, or the determination of foreign law on the basis of submission rather than evidence.
