Job Description
The Regional Legal Counsel will be located in Singapore. While the Regional Legal Counsel will be exposed to a wide range of legal work supporting the Adobe offices in the Asia Pacific region (which includes Korea, China, Hong Kong, Taiwan, India, Australia, New Zealand and countries in South-East Asia), the Regional Legal Counsel will head up legal support for the North Asia region (Korea, China, Hong Kong, Taiwan).
Primary responsibility is to:
Act as the key Legal partner for Sales teams in the region, providing guidance to and mentoring sales personnel as necessary to close deals for the company by employing ethical, sound and sensible business practices. This includes working on/negotiating revenue deals such as distributor and reseller agreements, integrated service vendor transactions, Software as a Service (SaaS)/hosting transactions, OEM licenses and direct enterprise software agreements.
Oversee Asia-Pacific Anti-Piracy enforcement and license compliance programs to ensure compliance with applicable laws and with Adobe’s Anti-Piracy corporate policies and procedures. This involves close management of all IPR administrative actions including developing and managing self-audit letters and warning letters as part of a consistent enforcement campaign for the region.
Mediate/Negotiate with customers and customers? counsel to address licensing issues. Act as an escalation path for licensing concerns and increase the efficiency of compliance audits.
Manage criminal prosecutions and civil and administrative actions with local authorities and with trade association(s) like the Business Software Alliance (BSA), their members, and their counsel. This involves evidence analysis, and close cooperation with the corporate Anti-Piracy enforcement team. Efficiently manage the POA requests and clearance requests, which include gathering data on each of the targets and coming to a decision about whether to proceed with an enforcement action. Work closely with Adobe’s corporate Anti-Piracy legal teams to ensure that the criteria used in the Asia Pacific region for target clearances are consistent with Adobe’s established practices. Review court documents, statements, affidavits, settlement agreements and other documents related to enforcement activities.
Desired Skills & Experience
Admitted as an advocate and solicitor in Singapore or qualified in another Commonwealth jurisdiction, with about 6-8 years of post-qualification experience.
Copyright-related and litigation experience required.
Experience in the software industry or knowledge of software industry practices is required.
Strong licensing background and experience in IP Law
Must be able to speak and read Mandarin, ability to write Chinese highly desirable
Excellent written and oral English skills required.
