Reed Technology and Information Services (Reed Tech), a LexisNexis® company, today announced the launch of LexisNexis PatentOptimizer® for Litigators, a new version of its PatentOptimizer™ drafting and analysis solution that has been tailored specifically for patent litigators.
The new service offering includes special tools to help litigators draft superior claim construction arguments, find important Section 112 anomalies to support their own patent invalidation arguments and generate charts to illustrate patent infringement claims that are supported by prior art analysis.
“While PatentOptimizer has been widely used by patent prosecutors to develop consistent, well-tailored patent applications, we also found that many of our current customers were adapting the technology for use in litigation,” said Ethan Eisner, Vice President and Managing Director of Global Commercial Markets for Reed Tech. “We listened to that feedback to develop PatentOptimizer for Litigators, a new purpose-built tool that leverages the best of PatentOptimizer, plus newly added capabilities designed to serve the unique needs of patent litigators.”
The primary new product features created for patent litigators include the following:
- Term Analysis Report – an auto-generated comprehensive terms report covering both intrinsic and extrinsic evidence that includes the ability to select elements directly from a patent claim or enter your own terms for analysis.
- Compare Docs – a new option in the Analytics section of the tool where litigators can now quickly identify changes that occurred during patent prosecution, including even the smallest of revisions between patent applications and patent grants.
- Analytics and Reports – users can generate as many as 10 different summary reports based on the analytics tools in the software to support invalidation arguments.
“Patent litigators are focused on arguing the scope and meaning of specific words in patent claims — either for the purpose of defending or invalidating asserted patents — and this new tool was built to empower the research and information needs of these professionals,” said Brian Elias, IP Planning Product Director. “Created by patent attorneys for patent attorneys, our PatentOptimizer and newly released PatentOptimizer for Litigators products streamline the legal workflow and serve as critical quality control checks when drafting patent applications or litigating a patent dispute.”
