The owner of a Buffalo restaurant is suing two downstate companies and their owners for alleged trademark infringement.
Casey Casas, the owner of Mister Sizzle’s Burgers Beer Shakes, is suing John Pantalena, Eric Pearson, Mr. Sizzles Expansion LLC, and Mister Sizzles Real Estate Holdings LLC.
Casas’ attorney, R. Anthony Rupp III, filed the complaint Monday in state Supreme Court.
Casas lives in East Aurora, Erie County. Pantalena and Pearson live in Westchester County.
Mr. Sizzles Expansion LLC was formed in September 2022 in Delaware, according to the suit. Mr. Sizzles Real Estate Holdings LLC, which is based in Westchester County, was formed in New York state in March, according to the complaint.
Pantalena and Pearson are officers of both entities, according to the complaint.
Casas owns the registered trademark Mister Sizzle’s Burgers Beer Shakes, according to the complaint. The restaurant bearing the name has operated since 2021 at 346 Connecticut St. in Buffalo.
“The goodwill generated by Mr. Sizzle’s use of its own name has been such that its name is now widely recognized by regional consumers, other food vendors, and providers, and consumers at-large,” according to the complaint.
