The maker of Naked juice products can pursue its trademark infringement suit against the seller of “Naked” protein powder over its expansion into energy drinks, a federal court said.
Naked Juice Co. of Glendora Inc. plausibly alleged that Naked Whey Inc.’s fruit-based energy drinks would confuse consumers, the US District Court for the Northern District of Illinois said. Naked Juice also adequately pleaded that its mark is famous by citing decades of use and considerable sales, the court said. It also advanced trademark dilution by blurring claims.
