Musk’s X Corp settles mass-tort ad agency’s trademark lawsuit over ‘X’ name

Sept 15 (Reuters) – Elon Musk’s X Corp has settled a trademark lawsuit brought by legal-marketing firm X Social Media over the “X” name, the companies told a Florida federal court on Monday.
X Corp and X Social Media asked the court, opens new tab to dismiss the case with prejudice, which means it cannot be refiled. X Social Media founder Jacob Malherbe confirmed in a statement that the case was settled, and said the company would change its name to Mass Tort Ad Agency. He did not disclose the settlement terms.
Spokespeople and attorneys for X Corp did not immediately respond to a request for comment on the settlement.
Malherbe’s Florida-based advertising agency specializes in recruiting plaintiffs for law firms bringing mass-tort lawsuits. It sued X Corp in October 2023, alleging that Musk’s rebrand of Twitter to X earlier that year had confused consumers and caused it to lose revenue.
X Corp responded by calling the lawsuit a “shakedown,” arguing that X Social Media had “peacefully coexisted for years” with hundreds of other X-related trademarks.
X Corp settled a separate lawsuit brought by advertising firm Multiply earlier this year for allegedly infringing its “X” trademark.
