Maker of Hot Chocolate ‘Bomb’ Alleges Trademark Infringed

A candy manufacturer filed a lawsuit alleging trademark infringement over the use of the word “Bomb” to describe ball-shaped chocolate filled with marshmallows.

Frankford Candy LLC claims that Mark Sanders LLC’s “Chocolate Bombs” are highly similar to its “Hot Chocolate Bomb,” which the plaintiff began selling in October 2019, in a complaint filed in the US District Court for the Eastern District of New York. The plaintiff allegedly trademarked “Bomb” in August 2021 after the product became one of its best-selling products, and it sent a cease and desist letter in December 2023 requesting the defendant stop using the trademark. …
