A dad from Bootle found himself in a disagreement with Hugo Boss after trying to register a trademark for his animal supplements business. Ben McDonald received a letter from the international fashion brand stating his business’s name breached their trademark.
Ben, 44, from Bootle told the ECHO how he is worried as to what the future might hold for his independent business, explaining he wouldn’t be able to take on Hugo Boss. After submitting an application to trademark his business, Boss Pets, he received a letter directly from the clothing brand.
“I got that letter and it felt like my whole world had collapsed. When I got the letter, I was getting flyers, business cards, banners made and delivered. I was just thinking I’m going to have to throw them all in recycling.”
Ben’s solicitor, Francis McEntegart, of MC Legal, initially submitted an application for Ben to trademark Boss Pets, arguing the use of the word Boss is commonly associated with meaning “good”. There is now a two-month period where people can object to the application, but Hugo Boss contacted Ben directly.
In a letter sent to Hugo Boss, Francis requested an apology from the international brand, as well as acknowledgement that the use of Boss Pets is not a trademark infringement.
