A home decor vendor can’t register a “Sazerac Stitches” trademark because some claimed goods are related to those covered in a liquor giant’s “Sazerac” registration, the Federal Circuit affirmed.
Despite a lack of direct overlap, evidence showed at least ten third parties sell the categories of goods covered in both Laurel Designs LLC’s application and Sazerac Brands LLC‘s registration, the US Court of Appeals for the Federal Circuit said. That supported the conclusion that consumers encountering “Sazerac Stitches” could perceive a connection to the distilled spirits company, whose marks cover glassware and cocktail accessories, the panel said.
