It’s all about the stripes…. Adidas loses US court bid to revive Thom Browne trademark lawsuit

May 3 (Reuters) – Athletic wear giant Adidas (ADSGn.DE), opens new tab failed on Friday to persuade a U.S. appeals court to reinstate its lawsuit claiming fashion house Thom Browne ripped off the company’s iconic three-stripe trademark.
Adidas had argued in its appeal that a Manhattan judge issued flawed instructions to the federal jury that rejected the lawsuit last year. A 2nd U.S. Circuit Court of Appeals panel disagreed, affirming on Friday, opens new tab that the jury instructions “appropriately reflected the law and evidence presented at trial.”
Adidas said in a statement that it is disappointed with the ruling and that it “continues to own a wide range of trademark registrations for the 3-Stripes mark which remain unaffected by this decision.”
