Title: Legal Counsel
Location: Shanghai, China
Report to: General Counsel
Main Goals and Objectives:
? The legal counsel, together with the general counsel, is responsible for legal supporting for the China’s business operation and development.
Responsibility:
? The Legal Counsel is responsible for contract drafting, review and negotiation for general commercial transactions; claim management and litigations; assisting general counsel for projects and general legal supporting;
? Contract drafting, review and negotiation:
– Revising, drafting and negotiating general commercial contracts (including goods and service purchasing contracts, franchise contracts, real estate contracts, logistic contracts and HR related contracts) .
? Claim management:
– Identifying legal issues in the clients’ claims, providing recommendations and legal opinions for CRM issues;
– Coordinating internally and externally for Product liability cases (including law firm management) .
? Project support and general legal support:
– Supporting general counsel for Project coordination and document review;
– Legal research and memo drafting for topical issues;
– Assisting general counsel in process review and directive implementation.
Business contacts required:
? Internal: All staff including Management team in China and Hongkong, relevant colleagues in Germany and other possible subsidiaries.
? External: External consultants, law firms, dealer network, suppliers and customers.
Threshold competencies:
? PRC qualified;
? 3-5 years post-qualification experience in law firms and/or multinational companies;
? Extensive experience in Franchise business and/or product liability case management;
? Experience with general corporate operational issues and commercial transactions;
? Undergraduate law degree from top ranking Chinese law school;
? Master degree in law (overseas law degree is a plus) ;
? Excellent English both orally and in written;
? Strong communication and interpersonal skills;
? Pragmatic and solutions driven;
? Diligent, adaptive and willing to learn;
? Able to transform legal issues into a workable solution within a business context.
