Forest River Inc. convinced a federal judge to enhance a $2 million jury award to $5.5 million following its victory against inTech Trailers Inc. for using “terra” and mountain designs on their recreational vehicles.
The enhancement is necessary to ensure trademark infringement isn’t rewarded, Judge Damon R. Leichty said, because inTech’s chief financial officer testified that the company made approximately $5.56 million from its sales of Terra trailers. “If inTech is left to profit from its trademark infringement, Forest River hasn’t been adequately compensated, and inTech inequitably has benefited from its willful wrongdoing,” according to an order issued Thursday in …
