A socialist system of laws with Chinese characteristics has been established, top legislator Wu Bangguo announced in his report of the work of the Standing Committee of the Nation People’s Congress (NPC) delivered at the second plenary meeting of the Fourth Session of the 11th NPC on Thursday, or March 10.

The goal has been attained “on schedule”, Wu said. This is a major milestone in the history of the development of China’s socialist democratic legal system and has great immediate and far-reaching historical significance. This socialist system of laws has touched off heated discussion on among NPC deputies in their panel discussions.

In his report, Wu reviewed the process of forming the socialist system of laws with salient Chinese features, which shows the Communist Party of China (CPC) is clear-headed, firm and steadfast politically, truth seeking in social practices, and forward exploring and innovative with the legal theory, said Li Zhanshu, Party secretary of southwest China’s Guizhou province. The organic unity adherence to leadership by the Party, ensuring that people are masters of the country and governing the country in accordance with law must be held, and this constitutes the core of the socialist system of law with Chinese hallmarks.

The socialist system of laws with salient Chinese feature is definitely to defend the Party’s leading position, citizens’ basic human rights, ethnic unity and the unity of the entire Chinese nation.

It is a major milestone in the development of the nation’s socialist system of laws with basic and major codes of each type already in place. There are various laws or regulations of social stratification to abide by and this forms the foundation for scientific development, noted Li Shishi, director of the Commission for Legislative Affairs of the NPC Standing Committee.

In fact, “people coming first” and the legislation or the enactment of laws for people represent one of the basic experiences for the socialist system of law with Chinese characteristics or one of the basic functions of the State in regards to administration.

Take the Law on Vehicle and Vessel tax the top legislature voted and passed on Feb. 25, which was aimed at standardizing taxation and promoting environmental awareness and energy efficiency, and it is a genuine law related very closely to the people’s rights and interests. Before having been submitted to NPC Standing Committee, the top legislature released the draft law in full at its website to the public to solicit opinions and collect and sort out approximately 100,000 proposals or suggestions thanks to an extensive involvement of all strata in society.

Moreover, the NPC Standing Committee made vital, important revisions to the Vessel and Vehicle Tax Law on the basis of absorbing public opinions of legislation in a bid to better comply with the public interests.

The Law on Vehicle and Vessel Tax has absorbed rich public opinions, and it is a very good example from legislation in a more scientific and democratic manner, according to Li Zhaoxing, former foreign minister and the spokesman for the annual session of China’s national legislature.

In order to introduce the scientific, legislative and democratic legislation, the NPC Standing Committee has enabled NPC deputies to play a proper role. Group meetings or panel discussions are conducted to solicitate ideas or to deliberate legislative bills. By the way of holding forums, seminars and hearings, etc, views from different social sectors are heard on an extensive scale, particularly from people at the grassroots level, so as to collect or draw on all useful opinions.

The legal system should also keep abreast with the times and go on innovating, and so it is bound to be dynamic, open and forward developing instead of being statistic, contained or fixed.

With the completion of the socialist systems of laws with Chinese features, we should also note that the cause of socialism is progressing and the reform and opening up keeps advancing, and this has placed new demands on China’s legal system and, as more new demands keep up improving, there is a lot to do in the fields of legislation, judicature, and law enforcement and supervision.
