The maker of the popular Furbo pet-monitoring system evaded claims that it infringed a patent for an “internet canine communication system” Friday when a Washington federal judge ruled the asserted patent doesn’t describe how Tomofun LLC’s Furbo works.
While Tomofun didn’t violate DoggyPhone LLC’s patent, Judge Barbara J. Rothstein said she needn’t decide counterclaims that the asserted patent is invalid.
DoggyPhone originally asserted its US Patent No. 9,723,813—which covers “enhanced methods and systems for human-pet communication”—against Tomofun in November 2019, alleging that the Furbo camera, audio system, and treat dispenser ripped off DoggyPhone’s design.
