A trademark lawsuit among relatives of Frida Kahlo over the rights to the artist’s intellectual property got a second chance Friday after a federal appeals court ruled the suit was wrongly dismissed.
Florida courts have jurisdiction over the Mexico-based defendants, which include Kahlo’s grand-niece and her company, Frida Kahlo SA de CV, said Judge Barbara Lagoa of the US Court of Appeals for the Eleventh Circuit. She reversed a district court’s dismissal because, despite that court ruling it lacked jurisdiction over the defendants, it has power to hear the case.
