A non-compete lawsuit against South Florida database pioneer Hank Asher was dismissed Monday.

In April, Reed Elsevier, the parent of LexisNexis, filed suit against Asher in Palm Beach County Circuit Court, alleging that he violated a non-compete agreement when he started TLO, a new Boca Raton-based technology company.

The dispute dated back to 2004, when Asher sold Boca Raton-based Seisint to LexisNexis for $775 million and signed a non-compete agreement that ends Sept. 1.

While he leased 143,000 square feet in Boca Raton late last year and was hiring staff for TLO, Asher maintained that the company was only giving away software to law enforcement to help track online child predators, which did not violate his non-compete.

Asher countersued, alleging that Reed Elsevier and LexisNexis? lawsuit was ?a sham filed to sustain their monopoly on database searching.?

The parties agreed to have all claims and counterclaims dropped, according to the order of dismissal in Palm Beach County Circuit Court. Each party must pay for their own attorney fees and expenses.
