Commercial database company Dun & Bradstreet Holdings Inc. can’t strike a putative class action over a librarians’ right of publicity the Ninth Circuit said Monday.
California’s anti-Strategic Lawsuits Against Public Participation (anti-SLAPP) statute doesn’t apply to suits brought solely to protect the public interest, the US Court of Appeals for the Ninth Circuit said. The right of publicity of millions meets the standard, as their names and personal information are allegedly used in free trials to help sell database access for thousands of dollars, the court said.
