Advertising & Marketing 2023
Published online on 17 October 2023
Contemporary society has turned into a global marketplace where goods and services can be provided not only through the known traditional channels but mostly via the internet; while offering unlimited purchasing access beyond the national borders, the internet also presents challenges and potential dangers that have brought governments to impose heavy legislation on e-commerce. Besides reporting on how advertising claims and endorsements are legislated according to jurisdiction, the Advertising & Marketing 2023 guide updates us on digital and social media not forgetting to cover misleading practices such as ‘ambush marketing’ and ‘dark patterns’.
There is certainly more to the policies relating to Environmental, Social and Governance, that discussion point commonly known as ESG, than climate change activism and the search for alternative sources of power.
These days no political agenda fails to mention an ESG discussion, whether this might be about pollution, food shortages, immigration or global warming. This subject matter relates to us all on a global scale and commands all governments to act without further delay. Even if it is impossible to predict how and when this action will finally take place, the ESG 2023 e-book can shed some clarification on such a broad and complex topic. We invite you to read this current and interesting guide which will be published on 9th November and already counts 24 law firms offering contributions on the theme.

White-Collar Crime refers to those non-violent offences involving obtaining or keeping money by deceit, or for a personal or business advantage. Introduced by Kiril Bougartchev and Emmanuel Moyne from French law firm Bougartchev Moyne Associés AARPI, the 4th edition of this popular title collates the views and opinions of leading experts from 26 different jurisdictions and offers an overview on the legislative regulation to prevent and prosecute offences in securities fraud, embezzlement, corporate fraud, anti-bribery law, tax fraud regulations, criminal competition law, cybercrime and anti-money laundering laws. As it explains how international law firms have been witnessing an increase in investigation and prosecution against any misconduct in White-Collar Crime, this e-guide is revealed to be an essential resource for practitioners to ensure that organisations behave more ethically on their path to success.

Beyond Borders: The Indian Antitrust Watchdog’s Quest for Global Turnover Penalties
This informative piece by Mohith Gauri and Toshit Shandilya from AZB Partners focuses on the Indian Parliament’s decision last April to approve amendments to India’s competition rules. While some of these amendments have already been imposed, the authors tell us, other provisions will be enforced in due course pending new regulations; the article also addresses how the Indian Supreme Court will be required to act, particularly with regard to the fines to charge in case of wrongdoings such as antitrust and anti-competitive behaviour, paying attention not to compromise a company’s operations, products and services.
Online Copyright Infringement in China: Suing for Illegal Video Streaming
Tim Yimin Liu, partner at Global Law Office, writes about the solid legal framework surrounding video copyrights in the People’s Republic of China. Such significant protection allows Chinese copyright owners to feel reassured they can take legal action against typical infringements such as the unauthorised streaming of a film or television series, or the re-editing of film (for instance combining it with other videos, music or audio) which is possible thanks to the short-form video platforms available now. The article reassures us that IP rights-holders have full entitlement to seek relief for any loss incurred and describes in detail all the steps required to file a successful claim.
St Kitts and Nevis Citizenship by Investment Programme – Developments in 2023
Maybe you were not aware that the gorgeous territories of St Kitts and Nevis in the Eastern Caribbean Sea proudly claim to have the longest-running ‘citizen by investment’ (CBI) programme in the world. To explain how this scheme works and how to achieve it, attorney Joseph Rowe guides us through the maze of options available to non-nationals who wish to apply, including real estate, private home sales investment, contributions to the local Sustainable Growth Fund (SGF) and the accelerated application process. This piece proves to be truly entertaining reading whether you are considering applying for citizenship in the islands, you are thinking to purchase your own slice of paradise or you are simply a daydreamer.
Protecting Family Wealth in the Event of a Divorce in England and Wales
Copying with a break-up is listed among the more stressful life experiences a human being can go through. But how can we be sure to protect our family health after a divorce? In this piece Sarah Hogarth from Edwards Family Law warns us to be prepared with research and advance planning, but also lists some of the most common strategies to adopt when protecting personal assets against a spouse’s claims in the event of divorce; these include loan agreements, gifts and trust funds, not forgetting the increasingly popular trend of nuptial settlements and prenuptial agreements, which are no longer left only to the super-wealthy.
