The lawyers suggest outside counsels and private investigators should lead the enquiries to avoid possible conflicts of interest while ensuring prudence, integrity, objectivity and confidentiality during these delicate and complex internal proceedings.

Stock-Based Incentive: The Danish Supreme Court Ruling in the Tesla Case

Benefits schemes and bonuses often prove to be an additional incentive whenever somebody applies for a new job. In this article, legal experts Lise Lauridsen and Sandro Ratkovic from Bech-Bruun describe an important amendment to the Danish Stock Option Act, which clarifies the rights of employees when they are offered awards as part of their employment contract. In the piece, the authors refer to the case of three former employees of Tesla Motors Denmark (TMD) for whom it was not clear whether they would be entitled to receive and/or purchase stock and share options after the termination of their employment contract, also because all three had been considered ‘bad’ leavers; the lawyers provide an interesting analysis of the case, the ruling and its implications.
