A garden hose company failed to convince the Eighth Circuit to nix a $3.2 million attorneys’ fees award or reverse cancellation of its trade dress registration covering chartreuse garden hoses.
A district court justifiably found Teknor Apex Co.’s litigation position justified, deeming it an exceptional case that warranted the fees award for Weems Industries Inc., the US Court of Appeals for the Eighth Circuit said Thursday.
