Australia: Law Firm Sues Partners Who Jumped Ship

Top-tier law firm Herbert Smith Freehills is suing eight of its partners who are leaving to join US-based global law firm White & Case.

The remaining 167 Australian partners at Herbert Smith Freehills have started proceedings in the Supreme Court of NSW to enforce certain provisions in the firm’s partnership agreement.

The parties appeared before the court on February 3 and are expected to reappear for directions on February 17.

White & Case poached 10 of Herbert Smith Freehills’ project and finance partners in September last year.

The partners included HSF Asia head of finance Brendan Quinn, head of projects Andrew Clark, and finance partners Alan Rosengarten, Josh Sgro, Tim Power, Jared Muller and Joanne Draper in Melbourne, Joel Rennie in Sydney, Fergus Smith in Hong Kong and Matthew Osborne in Singapore, who all resigned in September.

The Australian partners are subject to a six-month notice period, which will expire in March. After they leave the firm they will be subject to a further restraint period of six months.
