Law Professor: Foreign Companies Should Go to Court When Wrongly Accused

At least one expert on China’s competition law is suggesting foreign companies that feel wrongly accused of anti-trust violations shouldn’t be afraid to take their cases to the Chinese courts.

Wang Xiaoye, a law professor with the Chinese Academy of Social Sciences, says she feels frustrated seeing foreign companies backing away taking their cases to the legal system.

The professor says China’s competition law, which is modeled on European Union law, will give the parties a fairer hearing than China’s anti-trust watchdogs.

Chinese anti-trust investigations have targeted a number of high-profile foreign companies, including Microsoft, Mercedes, Audi, BMW and a number of Japanese auto part makers in recent weeks.

Most so far have been prepared to accept the fines handed down by the authorities, rather than appeal their cases in the courts.
