A North Texas smash burger restaurant is suing an upstart rival for trademark infringement in federal court in Wichita Falls.
Scoots Smashburgers Inc., which has a restaurant in Quanah, Texas, near the Oklahoma state line, sued Smash Daddy’s, a newer competitor that opened about 28 miles away in Vernon, Texas.
Scoots alleges that Smash Daddy’s owner, Jay Young, and his company, Jay Young Inc., “engaged in an intentional scheme to confuse consumers as to some association, affiliation, or relationship” between Smash Daddy’s and Scoots.
