According to AEO, the company used Aerie branding in paid advertisements and search results, directing customers to counterfeit products instead of genuine items. Allegations of Trademark Misuse
The lawsuit details how Amazon allegedly employed “flagrant, unauthorized use” of the Aerie trademark, tricking shoppers into believing that authentic Aerie products were available on their platform. The complaint states that clicking on these deceptive links led customers to pages filled with “knock-offs and ‘dupes'” of Aerie merchandise. American Eagle has maintained that it previously declined Amazon’s request to sell Aerie products, wanting to keep tight control over the brand’s identity and the customer shopping experience.
