Do Orlando International Airport officials lack legal authority to stop their smaller rival airport to the east from using “Orlando” in its name?
Yes, Orlando Melbourne International Airport’s attorneys argue.
Simmering for years, the naming dispute over the geographic designation “Orlando” continues in federal court. In March, the Greater Orlando Aviation Authority sued the Melbourne airport, claiming trademark infringement, false advertising and customer confusion.
Melbourne’s airport adopted the name Orlando Melbourne International Airport in 2010 in national and international marketing campaigns with US Airways, Delta and Direct Air.
The result? Website visits leaped from 1.5 million in 2009 to 5.0 million in 2010. The name and branding have been consistently used for nearly a decade, court records show.
On May 8, Melbourne airport officials filed a motion asking a U.S. District Court judge to dismiss the naming lawsuit. Why? The motion argues the Florida Legislature did not grant GOAA the power to own or enforce trademarks.
