According to the ABA Journal, the ABA Commission on Ethics 20/20, which is currently in the “information gathering mode,” has found that though all rating providers profess to employ a “completely transparent” methodology but one provider’s idea of what constitutes transparency may differ from another.
Speaking to the commission, Best Lawyers editor Steven Naifeh said the publication’s survey not only adopts a rigorous methodology but also spells out the accompanying materials relied on. Best Lawyers recently published rankings of U.S. law firms in collaboration with U.S. News & World Report,
Likewise, Avvo, which publishes an online directory of attorneys who have been rated on scale of one to 10, claims to follow a “very complex, very sophisticated” formula that takes into account a variety of factors, including education, work experience, licenses, publications, awards, testimonials from other lawyers and disciplinary records.
However, Avvo vice president Joshua King refuses to share the exact methodology used in its surveys, calling its “our own secret sauce.”
Aric Press, editor-in-chief of ALM, which owns the American Lawyer (publisher of the Am Law 100 – an annual ranking of the nation’s biggest and most profitable firms), told the commission that Am Law’s surveys are based on a variety of factors and sources, including information that comes directly from the law firms. Am Law, Press said, tries to be “as careful as possible” but conceded that the methodology used in some surveys could be “far from scientific.”
