A Florida federal judge has ordered the Florida Virtual School and its attorneys to pay $1.3 million after ruling that the state-funded institution filed an “abusive” lawsuit alleging trademark infringement against Stride Inc., a private competitor.
In April, Senior Judge Gregory Presnell of the Middle District of Florida ruled that the public virtual school, known as the FLVS, acted in “bad faith” and censured the school for pursuing the suit, which it lost initially and again on appeal. At the time, Presnell said the state school would face fines. The suit originally claimed $6 billion in damages.
The mandated amount, likely to be paid by the Orlando, Florida-based school, is based on an estimate that Stride spent on legal defense in the yearslong case. The order by Presnell, filed this week, limits how much some of the outside law firms that it hired will be required to pay, meaning that the school will likely foot the bill.
