Indonesia: Prosecutors File Appeal Against Acquittal of Lawyer Delpedro and Co. House of Representatives Confident Judge Will Reject Appeal

The Prosecutor’s Office has filed an appeal against the acquittal verdict against Delpedro Marhaen Rismansyah and his associates. Commission III of the House of Representatives is confident the panel of judges will reject the appeal.

Previously, on March 6, 2026, the panel of judges at the Central Jakarta District Court acquitted Delpedro; Lokataru Foundation staff member Muzaffar Salim; @gejayanmemanggil admin Syahdan Husein; and Riau University student Khariq Anhar of all charges and ordered the prosecutor to restore their rights, positions, and dignity.

The Head of the Legal Information Center of the Attorney General’s Office, Anang Supriatna, stated on Tuesday (7/4/2026) in Jakarta that the public prosecutor has filed a cassation legal effort against the acquittal verdict for Delpedro and others. He mentioned that the cassation effort is based on the old Criminal Procedure Code (KUHAP).

“Thus, in the case of Delpedro Marhaen Rismansyah et al. who were acquitted (vrijspraak) during the examination period, legal action is still subject to Law Number 8 of 1981 concerning Criminal Procedure Law, so that a cassation appeal is made for this case,” explained Anang.

Anang stated that the transitional provisions as stipulated in Article 361 letter c of Law Number 20 of 2025 concerning the Criminal Procedure Code indicate that criminal cases that have been submitted to the court and have already commenced examination processes shall continue to be examined, tried, and decided based on the provisions in Law Number 8 of 1981 concerning Criminal Procedure. However, except for the process of judicial review, the provisions in the 2025 Criminal Procedure Code shall apply.
