Why San Antonio lawyer Kirsten Carabin’s bid to trademark her name was denied

San Antonio lawyer Kirsten Carabin — who’s been engaged in a legal battle with her old firm Carabin Shaw over the use over her name — has failed in her bid to trademark her new firm’s name.

In a decision last month, the U.S. Patent and Trademark Office refused to grant the trademark registration for “Carabin Law” on the grounds that it is similar to “Carabin Shaw” and likely to cause “confusion.” Carabin Shaw received its trademark registration in 2014.

The agency issued its decision on “Carabin Law” in a “nonfinal” action. The firm can argue its case further by submitting evidence to the trademark office by Dec. 11 — but it may be an uphill fight.
