Political party symbols prohibited from trademark registration in Belize

This week, the Attorney General’s Ministry, in collaboration with the Belize Intellectual Property Office (BELIPO), officially amended the Trade Marks Rules to prohibit the registration of political party symbols as trademarks. This significant legal reform, enacted through Statutory Instrument No. 90 of 2025, is seen as a critical step in safeguarding Belize’s political heritage.

Announced on June 19, 2025, the amendment was authorized by the Minister responsible for Intellectual Property under section 71 of the Trade Marks Act, per a statement from the Attorney General’s Ministry. The new regulations prevent the Registrar of Intellectual Property from accepting trademark applications that incorporate political party symbols, thereby addressing a vital gap in the previous legal framework.

Before this amendment, political parties in Belize faced unique challenges because they were (and are) not recognized as legal entities under the Companies Act or any other legislation, which made it difficult for them to register their own symbols. This lack of legal recognition opened the door for individuals or entities unaffiliated with any political party to potentially exploit these identities by filing trademark applications for symbols traditionally associated with established parties, the AGM explained. Such actions could create confusion among voters and undermine the identity of political parties.

Under the revised rules, a political party symbol is defined comprehensively to include any insignia, logo, seal, flag, or name that has been associated with a political party that has fielded candidates in elections for at least ten years. The Attorney General’s Ministry has stressed that this reform does not restrict the lawful use of trademarks in commercial sectors but emphasizes that political identity should not be commodified.

While it is not yet available, a copy of Statutory Instrument No. 90 of 2025 and related legal documents will eventually be accessible on the Ministry’s website.
