Amazon.com Inc. must face claims that its 2018 movie “Gringo” infringed an author’s trademark for the title of his book after a split Ninth Circuit reversed dismissal Friday.
Daniel Davis sufficiently alleged “Gringo” in the title of his 2016 Amazon Best-Seller had become an enforceable trademark and that the movie’s title could confuse consumers, the US Court of Appeals for the Ninth Circuit said. A California federal court wrongly found the marks to be dissimilar based on the full title of the book—”Gringo: My Life on the Edge as an International Fugitive”—and widely varying covers, the three-judge panel’s majority held. …
