The filmmakers behind an Amazon Original film, “GRINGO,” defeated a trademark suit from the authors of a memoir with the same title, who alleged they used the same title for a movie in order to confuse consumers.
The US District Court for the Central District of California on Nov. 2 dismissed the suit with prejudice and said most factors in the likelihood of confusion test under the Lanham Act weighed against a likelihood-of-confusion finding, using a different standard than had previously been applied in the case.
