Brother of late Hong Kong Canto-pop diva Anita Mui loses trademark lawsuit against biopic production company Edko Films

  • Trademarks were related to precious metals, jewellery and time instruments

 

The eldest brother of late Canto-pop queen Anita Mui Yim-fong has lost a trademark violation claim against the production company behind a blockbuster biopic in Hong Kong.

The High Court on Monday dismissed the lawsuit filed by Peter Mui Kai-ming on Monday after finding it “clear and obvious” that he could not possibly win the case against Edko Films with two registered trademarks irrelevant to the movie Anita, or a third one covering cinematography, which had yet to be granted.

The court also ruled that the actress’s names contained in the film’s title and promotional materials offered nothing more than a description and nature of the show, and did not amount to using trademarks under the Trade Marks Ordinance.
