Update From Supreme People’s Court Monitor Re MOFCOM

MOFCOM just posted the draft legislation for public comment yesterday.  The link below links to comments from the MOFCOM spokesman, an official explanation of the draft, and the draft itself:

MOFCOM and related ministries have been working on this draft for over one year.  I assume the major chambers of commerce will organize comments on the draft legislation for their members.
The draft law is intended to coordinate China’s foreign investment legislation better with a future bilateral investment treaty with the US and EU, and also addresses currently existing VIEs.
There’s much there to think about.
